Affordable housing does not mean unsafe, unwanted, or out-of-place. It means the people who teach our kids, deliver our packages, protect our homes, serve our country, or who grew up here can actually afford to stay here.
Generally, affordable housing refers to places people can live without spending more than 30 percent of their income on their housing. And these homes often blend in with other homes in town. They are just legally limited in what they can be rented or sold for and whom they can be renter or sold to.
The New Jersey Constitution, via a law often referred to as the Mount Laurel Doctrine, along with the New Jersey Fair Housing Act and the Federal Fair Housing Law state that every town in a growth region of the State has a constitutional obligation to provide fair and decent affordable housing. If the municipality does not comply, a developer can sue, and if it is found that the municipality is not providing its regional share of affordable housing, the Court can order that the developer be allowed to build housing regardless of the underlying zone.
